Filing 10 ORDER (Clerk) After reviewing the foregoing motion, it appears the plaintiff appealed the district court's default judgment to the U.S. Court of Appeals for the Federal Circuit (Fed. Cir. No. 21-2298). The Federal Circuit has asked the parties to show cause why that appeal should not be transferred to this Court or dismissed. The appeal in this Court (3d Cir. No. 21-3135) is the defendants' appeal from an order denying their motion to vacate the default judgment. Briefing in this Court's appeal is STAYED until the Federal Circuit decides whether or not to transfer or dismiss the plaintiff's appeal. The parties must file written reports on the status of the Federal Circuit's appeal every sixty days, beginning on January 10, 2022. This Court will not issue a briefing schedule until the appropriate time after the Federal Circuit decides how its appeal will proceed. This stay will also provide the plaintiff an opportunity to retain counsel if desired. To that extent, his stay motion is granted. If any party objects to this stay, they should promptly file an appropriate motion. If the plaintiff believes the defendants' appeal should be dismissed, he may file a formal motion asking the Court to dismiss this appeal. Any motion must "state with particularity the grounds for the motion, the relief sought, and the legal argument necessary to support it." See Fed. R. App. P. 27(a)(2)(A).
