Filing 7 ORDER (Clerk) The foregoing motion is denied. To the extent Appellant asserts in the foregoing document that he is exempt from the Prison Litigation Reform Act (PLRA), it is noted that Appellant is presently incarcerated in the Pennsylvania prison system. The Court has no authority to waive fees for prisoners under the PLRA. See Porter v. Dept. of Treasury, 564 F. 3d 176, 180 (3d Cir. 2009). Under the Prison Litigation Reform Act, a prisoner filing an appeal in forma pauperis is required to pay the full amount of the filing fee even if that prisoner was granted in forma pauperis status in the District Court and paid the fees in support of his District Court action. 28 U.S.C. Section 1915(b). Accordingly, he must file an affidavit of poverty, 6 month prison account statement and authorization to withdraw funds within 14 days of the date of this order or the appeal may be dismissed.
