Filing 6 ORDER (Clerk) The foregoing motions are considered. The motion to proceed in forma pauperis is granted. The Court may reconsider in forma pauperis status or request additional information at any time during the course of these proceedings. No action will be taken on the motion to the extent it requests counsel. If Petitioner would like to move for the appointment of counsel, she must file a separate motion. The motion must state with particularity the grounds for the motion, the relief sought, and the legal argument necessary to support it. See generally Fed. R. App. P. 27. (PDB) [Entered: 04/08/2022 04:36 PM] |
Filing 5 MOTION by Sandra Harmon to Proceed In Forma Pauperis soley for the Appointment of Counsel, received and not filed. Certificate of Service dated 04/05/2022. Service made by US mail. (PDB) [Entered: 04/08/2022 11:38 AM] |
Filing 4 MOTION filed by Petitioner Sandra Harmon to Proceed In Forma Pauperis. (PDB) [Entered: 04/08/2022 11:36 AM] |
Filing 3 ORDER (Clerk) Action on the above captioned petition for writ of mandamus and motion for leave to proceed in forma pauperis is hereby deferred. The motion for leave to proceed in forma pauperis submitted with the mandamus petition was not sufficiently complete for the Court to rule on at this time. Petitioner must disclose in question #4 how much cash she and any spouse currently have. Within fourteen (14) days of the date of this order, Petitioner must file a signed, compliant motion for leave to proceed in forma pauperis and affidavit, or remit payment of the $500.00 filing fee. Another form affidavit is enclosed for Petitioner's convenience. As required by the affidavit form and statute, the motion must also be accompanied by a certified statement of Petitioner's institutional account for the six months prior to this date. It is noted that a petition for writ of mandamus is an original action and a separate motion for leave to proceed in forma pauperis must be filed for each petition filed, regardless of Petitioner's fee status in other proceedings. If the filing fee is not paid or a compliant motion and affidavit are not filed, the petition may be dismissed without further notice. See 3d Cir. L.A.R. Misc. 107.1. The petition will not be submitted to the Court until the filing fee or a compliant motion to proceed in forma pauperis is received. See Fed. R. App. P. 21(a)(3). In addition, a copy of the motion for leave to proceed in forma pauperis must be served on each party to the proceeding including the District Court judge. A certificate of service reflecting this must be submitted to the Court of Appeals, along with the original motion, within fourteen (14) days of the date of this order. See Rules 21 and 25, Federal Rules of Appellate Procedure. (PDB) [Entered: 04/01/2022 03:34 PM] |
