Filing 10 ORDER (Clerk) dismissing case, pursuant to F.R.A.P. 3(a) and LAR 3.3 and Misc. 107.1(a), for failure to pay the filing fee for the notice of appeal. Case terminated on 01/19/2023. (LMR) [Entered: 01/19/2023 04:50 PM] |
Filing 9 ORDER (SHWARTZ, Circuit Judge) Appellant's motion to proceed in forma pauperis is denied. Appellant indicates in his affidavit in support of his IFP application that he has no income, no assets, and no expenses. Similar applications were denied on numerous occasions by the United States District Court for the Eastern District of Pennsylvania . See, e.g., E.D. Pa. Civ. No. 2-22-cv-00310; E.D. Pa. Civ. No. 5-22-cv-01279; E.D. Pa. Civ. Bo. 2-22-cv-00377. Without a more complete picture of Appellant's financial circumstances, the Court cannot fairly determine whether he is economically eligible for IFP status. See Roman v. Jeffes, 904 F. 2d 192, 194 n.1 (3d Cir. 1990), superseded by statue on other grounds as stated in Brown v. Sage, 941 F. 3d 655, 659-60 (3d Cir. 2019) (en banc). If Appellant wishes to proceed with tgis appeal, he must pay the full applicable filing and docketing fees in the amount of $505 to the Clerk of the United States District Court for the Eastern District of Pennsylvania within 14 days of the date of this order. No extensions of time to pay the fees will be granted. Failure to pay the filing and docketing fees within that time will result in dismissal of the appeal without further notice. See 3d Cir. LAR Misc. 107.1 (a). If Appellant timely pays the filing and docketing fees within that time will result in dismissal of the appeal without further notice. See 3d Cir. LAR Misc. 107.1(a). If Appellant timely pays the filing and docketing fees, the appeal will be submitted to a panel of this Court for possible dismissal due to a jurisdictional defect, possible dismissal under 28 U.S.C. Section 1915(e)(2), and possible summary action under Third Circuit L.A.R. 27.4 and I.O.P. 10.6.. Panel No.: DLD-026. Shwartz, Authoring Judge. (TMM) [Entered: 11/21/2022 11:04 AM] |
