Filing 9 ORDER (BIBAS, Circuit Judges) Appellants letter, treated as a motion to vacate the August 31, 2022, Clerk Order granting Appellants motion to proceed in forma pauperis and assessing fees; and request to close appeal is granted. The August 31, 2022, Clerks Order is VACATED. It is hereby ORDERED that the warden of Appellants prison shall immediately cease assessing fees for the above-docketed appeal and the United States District Court for the District of New Jersey shall immediately cease collecting such fees. To the extent any fees have been assessed/collected, the District Court may wish to consider whether to refund the amount of such fees to the Appellants prison account. The request to withdraw the appeal is granted and the matter is hereby dismissed pursuant to Fed. R. App. P. 42(b) without cost to either party. A certified copy of this order is issued in lieu of a formal mandate. Panel No.: BCO-114. Bibas, Authoring Judge. (SB) [Entered: 09/19/2022 09:54 AM] |

Filing 7 ORDER (Clerk) granting motion to proceed in forma pauperis filed by Appellant Randy K. Washington. The appeal will be submitted to a panel for determination under 28 U.S.C. Section 1915(e)(2) or for summary action under Third Circuit L.A.R. 27.4 and I.O.P. 10.6. Appellant may submit argument, which should not exceed 5 pages, in support of the appeal. The document, with certificate of service, must be filed with the clerk within 21 days of the date of this order. Appellants motion for extension of time to file additional PLRA forms is denied as unnecessary as the Court already received his motion to proceed in forma pauperis and prison account statement, and the information included in those filings was sufficient to establish Appellants indigency.
