Filing 3 CLERK ORDER The two USAA appeals (Nos. 22-2231 and 22-2232) were previously consolidated for all purposes. The four Geico appeals (Nos. 22-2414, 22-2415, 22-2538, and 22-2557) are likewise consolidated for all purposes. In each group of consolidated appeals, the appellants must file a single, joint opening brief and (if filing one) a joint reply brief. Any response brief must also be filed jointly by all appellees in each group of appeals. To ensure these two groups of appeals can be briefed and considered together, all six appeals are consolidated for the purposes of scheduling and disposition. The briefing schedule that was previously issued in Nos. 22-2231 and 22-2232 is vacated. New briefing schedules will be issued at the appropriate time after all appeals are ready to proceed to briefing. The Court strongly disfavors redundant briefing. Similarly situated parties that are not required to file consolidated briefs should consider doing so or adopting portions of other briefs by reference. See Fed. R. App. P. 28(i). [22-2231, 22-2232, 22-2414, 22-2415, 22-2538, 22-2557] (AMR) [Entered: 08/26/2022 02:20 PM] |
