ORDER (Clerk) The foregoing are hereby considered. Action on the motion to proceed in forma pauperis will continue to be deferred. As previously advised, Appellant has had three previous cases dismissed as frivolous and may not proceed in forma pauperis unless he is in imminent danger. The cases are: Carroll v. Wright, E.D. Pa. No. 5-19-cv-00238; Carroll v. Mallon, E.D. Pa. No. 2-22-cv-00848; and Carroll v. Williams, E.D. Pa. No. 2-22-cv-02690. Therefore, Appellant must submit, within fourteen (14) days of the date of this Order, a motion demonstrating imminent danger of a serious physical injury. Failure to submit this motion within 14 days of the date of this Order will result in dismissal of the appeal without further notice. Once filed, the motion demonstrating imminent danger will be forwarded to a panel of this Court along with the motion to proceed in forma pauperis and the two responses to the September 15, 2022 Clerk's Order. If the Court determines that Appellant may proceed in forma pauperis, the Court will then proceed to determine whether the appeal will be dismissed as legally frivolous under 28 U.S.C. Section: 1915(e)(2) or whether summary affirmance under Third Circuit L.A.R. 27.4 and I.O.P. 10.6 is appropriate. In making this determination, the district court opinion and record will be examined. No briefing schedule will issue until this determination is made. Appellant may submit argument, not to exceed 5 pages, in support of the appeal. The document, with certificate of service, must be filed with the Clerk within 14 days of the date of this order. Appellee need not file a response unless directed to do so.
