Filing 18 ORDER (AMBRO, KRAUSE and MATEY, Circuit Judges) Aptsiauri's request for a certificate of appealability is denied because he has not "made a substantial showing of the denial of a constitutional right." 28 U.S.C. Section: 2253(c)(2). Jurists of reason would not debate that both of Aptsiauri's claims were unpersuasive, for substantially the reasons provided by the District Court in adopting the Magistrate Judge's report and recommendation, in light of the Magistrate Judge's findings of fact. See Miller-El v. Cockrell, 537 U.S. 322, 327 (2003); see also Hull v. Kyler, 190 F.3d 88, 98 (3d Cir. 1999); United States v. Igbonwa, 120 F.3d 437, 440-41 (3d Cir. 1997). In light of this disposition, Aptsiauri's motion for a stay of surrender pending appeal is denied.
