Filing 3 ORDER (Clerk) Appellants seek review of the District Court order entered March 16, 2023. The order on appeal is not final within the meaning of 28 U.S.C. Section 1291 and is not otherwise appealable at this time. Compare Mitchell v. Forsyth, 472 U.S. 511, 530 (1985), with Johnson v. Jones, 515 U.S. 304, 319-20 (1995), and Monteirp v. City of Elizabeth, 436 F. 3d 397, 405 (3d Cir. 2006); see also Barton v. Curtis, 497 F. 3d. 331, 336 (3d Cir. 2007); Doe v. Groody, 361 F. 3d 232, 237-38 (3rd Cir. 2004); In re Montgomery County, 215 F.3d 367, 373-74 (3d Cir. 2000). All parties must file written responses addressing this issue, with a certificate of service attached, within fourteen (14) days from the date of this order. The appeals at Nos. 23-1723 and 23-1724 are hereby consolidated for purposes of scheduling, joint appendix, Appellee Evans' brief, and disposition, should a briefing schedule issue in these cases. If a briefing schedule issues in these cases, Appellants are encouraged to consult with one another regarding the contents of their briefs as the Court disfavors repetitive briefs. Appellants may file a consolidated brief or join in or adopt portions by reference. See Fed. R. App. P. 28(i). It is noted that Appellees' briefs must be filed and served within thirty (30) days of the date of service of the last Appellant's brief. The parties are hereby directed to electronically file documents on the Court's docket as follows: Appellant: All case opening forms, motions, and briefs must be filed only in the appeal number assigned to the filer's notice of appeal. If a document is being filed jointly by multiple appellants, the document must be filed only in the appeal numbers assigned to the filing appellants. Appellees: All case opening forms must be filed in all appeals in which the appellee intends to participate. All motions should be filed only in those cases for which the relief is being requested. All responsive briefs should be filed only in the appeal to which the appellee is responding. If the appellee is filing a consolidated response brief, the brief must be filed in all appeals to which the appellee is responding. The consolidated joint appendix must be filed in all appeal numbers. The parties are advised that case opening forms for later filed appeals must only be filed in the new appeals and not re-filed in earlier appeals in which the forms were previously filed. The parties are further advised that failure to file documents in the appropriate case may result in the issuance of a noncompliance order.
