ORDER (Clerk) Appellant seeks review of the District Court's March 30, 2023 order striking four electronic filings that Plaintiff/Appellant made on March 27, 2023 and March 28, 2023 (Docket Item Nos. 63, 64, 65, and 66). The four filings related to a new complaint that Mr. Fallin attempted to file through the District Court's electronic case filing system. A new action was opened in the District Court on March 31, 2023, in response to Mr. Fallin's filing of a paper copy of the stricken complaint (Docket Item No. 63). The March 30, 2023 order may not be appealable at this time as the underlying District Court case was transferred to the United States District Court for the Eastern District of Tennessee. The parties must file responses addressing this Court's authority over the appeal. In addition, it is unclear what relief Appellant is seeking from this Court as the new complaint is pending at M.D. Pa. No. 1-23-cv-00553. Given this, the parties should also address whether summary action under Third Circuit L.A.R. 27.4 and I.O.P. 10.6 is appropriate in the event the Court does have jurisdiction.
