Filing 3 POSITIVE DISCLOSURE STATEMENT filed on behalf of Petitioner NRG Power Marketing. (PDB) [Entered: 06/01/2023 11:13 AM] |
Filing 2 CLERK ORDER The three petitions at Nos. 23-1778, 23-1790, and 23-1808 were previously consolidated for the purposes of scheduling, the joint appendix, the respondent's brief, and disposition. The new petition at No. 23-1984 is consolidated with the first three petitions for the same purposes. Petitioners are encouraged to consult with one another regarding the contents of their briefs as the Court disfavors repetitive briefs. Petitioners may file a consolidated brief or join in or adopt portions by reference. See Fed. R. App. P. 28(i). These four petitions seek review of the same FERC order. FERC must therefore file a single, consolidated administrative record (or certified list) with the records relating to all four petitions. The consolidated administrative record must be filed within forty days of this order. Contrary deadlines set in prior orders should be disregarded. In the first three cases, FERC has moved to delay filing of the record until September 5, 2023. That motion remains pending, and unless the Court orders otherwise, the decision made on that motion will govern record filing in all four cases. If any party objects to extending the record-filing deadline until September 5, 2023, their opposition must be filed by June 12, 2023.. [23-1778, 23-1790, 23-1808, 23-1984].
