June 6, 2023 Filing 3 NONCOMPLIANCE Order Action on the petition for writ of mandamus and motion for leave to proceed in forma pauperis is hereby deferred. The motion for leave to proceed in forma pauperis submitted with the mandamus petition was not sufficiently complete for the Court to rule at this time. An IFP motion must be accompanied by an affidavit that shows the petitioner's inability to pay in the detail prescribed by the form annexed to the Federal Rules of Appellate Procedure. See Fed. R. App. P. 24(a). The petitioner's affidavit said his income, expenses, and assets were largely "unknown". Within fourteen (14) days of the date of this order, Petitioner must either remit payment of the $500 docketing fee or complete his motion for leave to proceed in forma pauperis by filing a complete affidavit of poverty. A form affidavit is enclosed for Petitioner's convenience. The mandamus petition will not be submitted to the Court until the docketing fee has been paid or leave to proceed in forma pauperis have been granted. See Fed. R. App. P. 21(a)(3). If neither the fee nor a compliant motion to proceed in forma pauperis is received by the deadline, the petition will be dismissed without further notice. See 3d Cir. L.A.R. 24.2, 107.1.
