Filing 25 ORDER (Clerk) These two appeals are from the same district-court action. Broadly speaking, the plaintiff's first appeal is from an order dismissing her claims against some defendants. The district court then addressed the other defendants, and the plaintiff filed her second appeal. Various duplicate and amended notices of appeal have also been filed. The plaintiff's first appeal was previously dismissed for failure to pay the required $505 in fees. She moved to reopen that appeal but was informed that no action would be taken on that motion unless she satisfied the fees by August 8, 2023. The plaintiff tendered one $505 check to the district court, received on August 9, 2023. This Court credited the payment to the plaintiff's open second appeal. In the plaintiff's present motion, she asks that her two appeals be consolidated and that she be allowed to proceed without paying a second $505 payment. Both requests are DENIED. Fees of $505 are required for each appeal that the plaintiff chose to begin, even if they are related or consolidated. See, e.g., Ammons v. Gerlinger, 547 F.3d 724, 726 (7th Cir. 2008); Lebron v. Russo, 263 F.3d 38, 4042 (2d Cir. 2001). The plaintiff's request to waive the fees due for one of her appeals is DENIED. See Porter v. Dep't of the Treasury, 564 F.3d 176, 17980 (3d Cir. 2009) ("[T]he Clerk of this Court is authorized to deny future motions [. . .] to waive appellate filing and docketing fees."). The plaintiff's first appeal remains dismissed, and no further action will be taken on her motion to reopen it because she did not satisfy the fees by the deadline set in the Clerks' noncompliance order and still has not paid a second $505 in fees. The request to consolidate or "merge" the two appeals is DENIED without prejudice to seeking consolidation in the event the first appeal is reopened. This denial does not affect the scope of the plaintiff's second appeal (i.e., whether that appeal implicates the district court's earlier decisions that may have merged into the later orders on appeal).
