September 5, 2023 Filing 2 NONCOMPLIANCE Order sent to Petitioner Thomas L. Hill, Sr. requesting Compliance due 09/19/2023. On August 31, 2023, this Court received a document from Thomas L. Hill, Sr., titled Application and Petition for Extraordinary Redress of Writ of Habeas Corpus and Subjiciendum as Preserved at Art. I, Sect. 9, cl. 2 of the Constitution of the United States. It named Mr. Hill as the petitioner and Jessica Sage, the Warden of Lewisburg USP, as the respondent. Because the document appears to seek relief from this Court under the All Writs Act, 28 U.S.C. Section 1651, it has been docketed in this Court as a petition for an extraordinary writ. See Fed. R. App. P. 21. If Mr. Hill intended this document to be a petition for writ of habeas corpus, any such petition must be filed in the appropriate federal district courtnot in this Court. Action on the petition is hereby deferred. Petitioner did not submit the filing fee or a motion for leave to proceed in forma pauperis with the petition. Within fourteen (14) days of the date of this Order, Petitioner must either file a motion for leave to proceed in forma pauperis and affidavit or remit payment of the $500.00 filing fee. A form affidavit is enclosed for Petitioners convenience. As required by the affidavit form and statute, the motion must be accompanied by a certified statement of Petitioners institutional account for the six months prior to this date. If the filing fee is not paid or the motion is not filed, the petition may be dismissed without further notice. See 3d Cir. L.A.R. Misc. 107.1. Petitioner must also serve the petition on each party to the proceeding (or on counsel for the party) and provide a copy of the petition to the District Court judge, if applicable. See Fed. R. App. P. 21(a)(1). In addition, a copy of the motion for leave to proceed in forma pauperis must be served on each party to the proceeding, to include the District Court judge, if applicable. A certificate of service reflecting that the petition and motion have been served must be submitted to the Court of Appeals within fourteen (14) days of the date of this Order. See Rules 21 and 25, Federal Rules of Appellate rocedure. The petition will not be submitted to the Court until the filing fee or motion to proceed in forma pauperis, affidavit, and certified account statement, and the certificate of service are received..
