Date Filed Document Text
December 16, 2023 Filing 24 Document from Appellant Ashu Shukla titled "Per Plaintiff's filing on Appeal# 22-2727, the Plaintiff does not intend to seal Motion# 8 for extension of time to pay fees". Clerk's office made service on 12/18/2023. Service made by ECF. (AMR) [Entered: 12/18/2023 04:40 PM]
December 15, 2023 Opinion or Order Filing 23 ORDER (Clerk) The foregoing submission is considered. To the extent Appellant requests an extension of time to pay the filing fees, the request is granted. Within twenty-one (21) days of the date of this order, Appellant must pay the full filing and docketing fees in the amount of $505.00 to the District Court or file a motion for leave to proceed in forma pauperis. Failure to pay the fees or file a motion for leave to proceed in forma pauperis within the time stated will result in the dismissal of this appeal without further notice. See 3d Cir. LAR Misc. 107.1(a). Any further requests for extension of time will be presented to the Court and should be based on exceptional circumstances. (AMR) [Entered: 12/15/2023 02:51 PM]
December 11, 2023 Filing 22 RESPONSE on behalf of Appellant Ashu Shukla to clerk order. Clerk's office made service on 12/11/2023. Service made by ECF. (AMR) [Entered: 12/11/2023 09:14 AM]
December 8, 2023 Opinion or Order Filing 21 ORDER (Clerk) The foregoing motion is denied. The appeal at No. 22-2727 has concluded. The Court issued a decision on September 15, 2023, dismissing the appeal for lack of jurisdiction. Except for the appellant's opportunity to seek rehearing, the Court's decision concluded the appeal. The appellant's petition for rehearing is currently pending with the Court and the parties will be advised when a decision has been entered. The appellant is further advised that separate fees are assessed for each appeal, even if the appeals involve the same underlying district court action. See, e.g., Lebron v. Russo, 263 F.3d 38, 4042 (2d Cir. 2001) (noting that separate fee is due for each notice of appeal). (AMR) [Entered: 12/08/2023 04:23 PM]
December 8, 2023 Opinion or Order Filing 20 ORDER (Clerk) The foregoing submissions are considered. Appellant's "sealed" motion to file motion under seal, for extension of time to pay the fees, and for stay of the payment of filing fees is granted in part. Pursuant to the Clerk's letter dated November 28, 2023, Appellant must pay the full filing and docketing fees in the amount of $505.00 to the District Court or file a motion for leave to proceed in forma pauperis no later than December 12, 2023. Failure to pay the fees or file a motion for leave to proceed in forma pauperis within the time stated will result in the dismissal of this appeal without further notice. See 3rd Cir. LAR Misc. 107.1(a). To the extent Appellant requests to file the motion under seal, action is hereby deferred. The Clerk will hold the motion provisionally under seal pending resolution of the fee issue. No action will be taken on Appellant's motion requesting that the Court grant the Appellee an extension of time to respond to Appellant's motion insofar as Appellant lacks standing to request an extension on behalf of parties he does not represent. Action on Appellant's motion to be excused from filing a brief and for summary judgment, together with addendum correcting the motion for summary judgment, is also deferred pending resolution of the fee issue. If Appellant pays the full filing and docketing fees or files a motion for leave to proceed in forma pauperis, and in forma pauperis status is granted, then the motion to seal and the motion to be excused from filing a brief and for summary judgment with addendum will be forwarded to a panel of this Court for consideration.
