Date Filed Document Text
November 3, 2023 Filing 2 NONCOMPLIANCE Order sent to Petitioner Mr. Keith Dougherty. On November 2, 2023, this Court received a document from Keith Dougherty titled "Mandamus Pursuant to the All Writs Act; 28 USC Sec. 1651 Inclusive of the Habeas Corpus Act of 1679 Ninth and Tenth Amendment(s) [Range] 'The Bruen Test.'" The document suggested it was related to cases in the U.S. District Courts for the Eastern District of Pennsylvania, the Middle District of Pennsylvania, the District of New Jersey, and the District of Columbia. Action on the petition for writ of mandamus is hereby deferred. Petitioner did not submit the filing fee or a motion for leave to proceed in forma pauperis with the mandamus petition. Within fourteen (14) days of the date of this order, Petitioner must either file a motion for leave to proceed in forma pauperis and affidavit or remit payment of the $500.00 filing fee. As required by the affidavit form and statute, the motion must be accompanied by a certified statement of Petitioner's institutional account for the six months prior to this date. If the filing fee is not paid or the motion is not filed, the petition may be dismissed without further notice. See 3d Cir. L.A.R. Misc. 107.1. Petitioner must also serve the petition on all parties to the district-court proceedings and on the district courts themselves. See Fed. R. App. P. 21(a)(1). The petition stated a copy was mailed to the U.S. District Court for the Eastern District of Pennsylvania, but it was not sent to the three other courts that Petitioner claims are involved in this petition (The U.S. District Courts for the Middle District of Pennsylvania, the District of New Jersey, and the District of Columbia). A certificate of service reflecting that the petition has been served must be submitted to the Court of Appeals within fourteen (14) days of the date of this order. See Rules 21 and 25, Federal Rules of Appellate Procedure. The petition will not be submitted to the Court until the filing fee or motion to proceed in forma pauperis and affidavit and the certificate of service are received. See Fed. R. App. P. 21(a)(3). At the top of the petition, Petitioner wrote that it was "file[d] under seal due to content." With few exceptions, documents filed in this Court are publicly accessible. If Petitioner believes his petition should be sealed, he must file a motion asking the Court to grant that relief. See 3d Cir. L.A.R. 106. Unless such a motion is filed and granted, the petition will remain unsealed and publicly accessible. Compliance due 11/17/2023. SEE ORDER FOR COMPLETE TEXT. (ARR) [Entered: 11/03/2023 04:25 PM]
