ORDER (Clerk) On November 9, 2023, this Court received the Application Under 28 U.S.C. Section 2244 for an Order Authorizing the District Court to Consider a Second or Successive Application for Relief Under 28 U.S.C. Section 2254. Petitioner seeks permission to file a second Section 2254 motion challenging criminal convictions entered in Yakima County, Washington, and King County, Washington. Petitioner is currently detained at the Stafford Creek Corrections Center, and the Superintendent of that facility would be the proper respondent in any 2254 action. Such action would be filed in the United States District of Washington. The Western District of Washington is within the Ninth Circuit. The parties are hereby directed to submit written responses within 14 days from the date of this order, addressing whether the application should be transferred to the United States Court of Appeals for the Ninth Circuit.
