Filing 3 NONCOMPLIANCE Order sent to Petitioner Mr. Raphael Mendez Action on the above-captioned petition for writ of mandamus is hereby deferred. Petitioner did not provide a copy of the petition for writ of mandamus to the District Court judge. See Fed. R. App. P. 21(a)(1). Additionally, while Petitioner did submit a motion for leave to proceed in forma pauperis with the mandamus petition, he did not submit, as required by the affidavit form and statute, a certified statement of his institutional account for the six months prior to this date. Within fourteen (14) days of the date of this Order, Petitioner must either file a motion for leave to proceed in forma pauperis and affidavit including a certified institutional account statement or remit payment of the $600.00 filing fee. certificate of service reflecting that the petition and the motion for leave to proceed in forma pauperis have been provided each party in the proceedings, as well as to the District Court judge, must be submitted to the Court of Appeals within fourteen (14) days of the date of this Order. If proof of service is not filed with the Court, the petition may be dismissed without further notice. In addition, the petition will not be submitted to the Court until proof of service is received.
