The order appealed is not final within the meaning of 28 U.S.C. 1291 and is not otherwise appealable at this time. See Stradley v. Cortez, 518 F.2d 488 (3d Cir. 1975). On April 4, 2024, Plaintiff/Appellant filed a motion to certify the March 14, 2024 order for immediate appeal pursuant to Fed. R. Civ. P. 54(b) and 28 U.S.C. Section 1292(b). That motion is still pending in the District Court. All parties must file written responses addressing this Courts authority over the appeal, with a certificate of service attached, within fourteen (14) days from the date of entry of the District Courts order disposing of the motion to certify.
