Filing 13 ORDER (Clerk) The foregoing motion is denied as presented. The June 14, 2024 listing of the case for possible dismissal does not relieve Appellants from the obligation of filing case opening forms. Failure to file the case opening forms is grounds for dismissal of the appeal pursuant to 3d Cir. L.A.R. Misc. 107.2. In addition, a review of the District Court docket does not show any hearings having been held below. Therefore, it does not appear that there are any transcripts to be produced for this appeal, let alone produced at the governments expense. Accordingly, within fourteen (14) days of the date of this order, Appellant must file the following: Entry of Appearance Form; Civil Appeal Information Statement; Concise Summary of the Case, and Transcript Purchase Order Form. Additionally, any response to the June 14, 2024 Clerk Order directing the parties to address the appealability of the District Court transfer order must be filed in this Court. Filing a response in the District Court is not sufficient. Any response that Appellants want the Court to consider must be filed in this Court within fourteen (14) days of the date of this order. The parties responses will then be forwarded to a panel of the Court for consideration. (SB) [Entered: 07/29/2024 12:24 PM] |

The docketing and filing fees of $605.00 must be paid to the District Court within 14 days of the date of this order. If the fees are not paid within the time stated, the appeal will be dismissed without further notice pursuant to 3d Cir. L.A.R. 3.3 and Misc. 107.1. (SB) [Entered: 07/10/2024 10:01 AM] |
