Filing 19 ORDER (Clerk)The motion to dismiss is denied. At the time Appeal No. 24-2120 was opened, it was designated as a cross-appeal to Appeal No. 24-2033. This was done to facilitate consolidated briefing of the cases. Copies of the case dockets showing this designation are included with this order. In addition, it is this Courts practice to issue a formal briefing and scheduling order once appeals are ready to be briefed. Briefing deadlines are not automatically set at case opening. Given this, the Appellees/Cross-Appellants have not failed to timely file their brief in No. 24-2120. It is noted that Appellant/Cross-Appellee Sawicki already filed her opening brief in No. 24-2033, which is designated as the first-step brief. The remaining briefing schedule for the two appeals is as follows: 1. Second-step brief of Appellees/Cross-Appellants Borough of Huntingdon and Richard A. Wilson, opening as to their issues on appeal in No. 24-2120 and responsive as to the brief filed in No. 24-2033, must be filed and served within thirty (30) days of the date of this order. 2. Third-step brief of Appellees, responsive to the briefs filed by Appellant/Cross-Appellee Sawicki in No. 24-2033 and Appellees/Cross Appellants in No. 24-2120, must be filed and served within thirty (30) days of the date of service of the second-step brief. 3.
