| Filing 2 NONCOMPLIANCE Order: On October 9, 2024, this Court received Petitioner's motion under 28 U.S.C. Section: 2244 for an Order Authorizing the District Court to Consider a Second or Successive Application for Relief Under 28 U.S.C. Section: 2255. Additional documents are required for the Court to consider Petitioner's motion. Accordingly, it is hereby ORDERED that Petitioner submit the following documents within 21 days of the date of this order: (1) The prior motion under 28 U.S.C. Section: 2255 filed in E.D. Pa. No. 2-17-cr-00119-001; and (2) the district court opinion(s) and/or order(s) regarding the prior motion under 28 U.S.C. Section: 2255 in E.D. Pa. No. 2-17-cr-00119-001. See 3d Cir. L.A.R. 22.5(a). Because the proper documents were not included with the Section: 2244 application, the application is deemed lodged with the Court. It is noted that if Petitioner requires copies of these documents from the District Court, there will be a charge for copy work, payable to the Clerk of the District Court. In addition, any request for copy work must be made directly to appropriate District Court. A copy of these documents must be served on the U.S. Attorney for the Eastern District of Pennsylvania. Petitioner must also file a certificate of service with the Clerk of the Court of Appeals demonstrating that these documents have been served. Respondent may file a response within seven days of the filing of Petitioner's completed application. The deadlines set forth in this order supersede any other deadlines set in this case. No action will be taken regarding Petitioner's application until copies of the above-listed documents are received by the Clerk. Failure to file these documents before the deadline may result in the dismissal of the case. Compliance due within 21 days. (AMR) [Entered: 10/10/2024 03:49 PM] |
