Filing 12
ORDER (BIBAS, PORTER and MONTGOMERY-REEVES, Circuit Judges) Appellant's "Motion to Remand for Limited Discovery" is denied. To the extent that Appellant's "Motion to Supplement the Record on Appeal" (hereinafter "Motion to Supplement") seeks to supplement the record with documents that were filed in the District Court (and thus are already part of the record), the Motion to Supplement is denied as unnecessary. The Motion to Supplement is otherwise denied, for Appellant has not demonstrated that this case presents "exceptional circumstances" warranting supplementation of the record. See Burton v. Teleflex Inc., 707 F.3d 417, 435 (3d Cir. 2013). Since the "DD 214" form submitted by Appellant on appeal at docket entry # 9 is not part of the record, the Clerk is directed to strike that document from the docket. So stricken, we deny as unnecessary Appellant's motion to seal that document. To the extent that Appellant's "Motion to Seal [His] DD 214" seeks any other relief, that relief is denied. Lastly, Appellant's "Motion to Unseal Documents for Appellate Review" is granted in part and denied in part. Specifically, that motion is (a) granted to the extent that it asks us to confirm that we have access to the portion of the record that was sealed by the District Court, and (b) otherwise denied. Further to the Clerk's April 22, 2025 order, Appellant must file his brief within 30 days of the date of our order here. Panel No.: ALD-149. Porter, Authoring Judge. (ARR) [Entered: 05/20/2025 04:54 PM]
