ORDER (Clerk) No action will be taken on the foregoing submission. In No. 25-1748, the Court denied Jones's petition for writ of mandamus on June 27, 2025. That order concluded the proceedings in that case. In No. 25-1787, the Court summarily affirmed the district court's decision on August 22, 2025. Except for Jones's opportunity to seek rehearing, that decision concluded the appeal. It is noted that Jones's petition for rehearing is currently pending with the Court. The parties will be advised when a decision has been entered on the petition for rehearing.. [25-1748, 25-1787]. (PDB) [Entered: 10/24/2025 03:50 PM]

ORDER (Clerk) Jazzmin Jones electronically filed the above-listed documents in both No. 25-1748 and No. 25-1787. The motion to recall the mandate will be submitted to the Court in No. 25-1748 for whatever consideration the Court deems appropriate. In that case, the Court denied Jones's petition for a writ of mandamus on June 27. The Court does not issue mandates after deciding petitions for writs of mandamus. No action will be taken on the motion to recall the mandate in No. 25-1787. The Court summarily affirmed the district court's decision on August 22, but the Court's mandate has not yet issued. No mandate will issue until Jones has a chance to seek rehearing. See Fed. R. App. P. 41(b). Jones's petition for rehearing challenges the decisions made by the Court in No. 25-1787. It will be considered in that case only. Because it is now clear Jones's earlier motion was not her petition for rehearing, the August 29 noncompliance order issued in No. 25-1787 is vacated. Under this Court's Local Appellate Rules 35.2(a) and 40.1(a), petitions for rehearing may include copies of the Court's decisions as to which rehearing is sought. Other exhibits are not authorized. Jones's petition for rehearing includes unauthorized exhibits. If she wants the Court to consider her petition for rehearing, she must file a motion asking the Court for permission to include those exhibits. That motion must be filed in No. 25-1787 within fourteen days of this order. No action will be taken on the petition for rehearing until this deficiency is corrected. [25-1748, 25-1787]. Filing 25
ORDER (KRAUSE, PHIPPS and SCIRICA, Circuit Judges) The order entered on June 12, 2025 is VACATED, having been issued in error. Jazzmin Jones's petition for a writ of mandamus is denied. To obtain a writ of mandamus, "a party must establish that (1) no other adequate means [exist] to attain the relief he desires, (2) the party's right to issuance of the writ is clear and indisputable, and (3) the writ is appropriate under the circumstances." Hollingsworth v. Perry, 558 U.S. 183, 190 (2010) (per curiam) (alteration in original) (internal quotation marks and citation omitted). To the extent that Jones asks this Court to compel the District Court to issue an injunction and declaratory relief facilitating the return of her minor children to her custody, she has not shown that her right to such relief is clear and indisputable or appropriate under these circumstances. Jones has not otherwise raised any issue that warrants mandamus relief. To the extent that she has asked this Court to directly intervene in her pending state child custody proceedings, we deny her requests for substantially the reasons given by the District Court, as Jones has not established circumstances that warrant injunctive or declaratory relief at this time. See Sprint Commc'ns, Inc. v. Jacobs, 571 U.S. 69, 79 (2013); Middlesex Cnty. Ethics Comm. v. Garden State Bar Ass'n, 457 U.S. 423, 435 (1982); Moore v. Sims, 442 U.S. 415, 419-20 (1979); Younger v. Harris, 401 U.S. 37, 53-54 (1971); Malhan v. Sec'y U.S. Dep't of State, 938 F.3d 453, 461 (3d Cir. 2019). Her remaining motions and requests for relief are denied.. Panel No.: CLD-159. Filing 22
ORDER (KRAUSE, PHIPPS and SCIRICA, Circuit Judges) Appellant Jazzmin Jones's requests for injunctive and declaratory relief are denied. Jones asks this Court to issue an order facilitating the return of her minor children to her custody while her state child custody proceedings are pending, and to issue prospective declaratory relief against individuals and entities involved with those proceedings. For substantially the reasons given by the District Court in denying her requests for injunctive and declaratory relief, we conclude that Jones has not established circumstances that warrant injunctive or declaratory relief at this time. See Sprint Commc'ns, Inc. v. Jacobs, 571 U.S. 69, 79 (2013); Middlesex Cnty. Ethics Comm. v. Garden State Bar Ass'n, 457 U.S. 423, 435 (1982); Moore v. Sims, 442 U.S. 415, 419-20 (1979); Younger v. Harris, 401 U.S. 37, 53-54 (1971); Malhan v. Sec'y U.S. Dep't of State, 938 F.3d 453, 461 (3d Cir. 2019). Jones's remaining pending motions are denied. Jones is advised that we will consider taking summary action in this appeal. See 3d Cir. L.A.R. 27.4; 3d Cir. IOP 10.6. Jones may file a response on that issue, not to exceed five pages, within 14 days of the date of this order. This response also should address whether and to what extent this Court has appellate jurisdiction given that some of her claims remain pending before the District Court. See 28 U.S.C. Section 1291 & 1292(a)(1); Fed. R. Civ. P. 54(b). Panel No. CLD-159. Scirica, Authoring Judge. (PDB) [Entered: 06/12/2025 03:53 PM]

| Filing 17 TEXT ORDER (Clerk): As stated in this morning's noncompliance order, action on this mandamus petition is deferred. The petitioner needs to file a certificate of service showing that she provided a copy of her mandamus petition to the district-court judge. The motion filed in response to the noncompliance order references a certificate of service filed on 5/19/25, but that is insufficient. It mentions a motion and notice, but not the mandamus petition, and it does not mention the district-court judge. The petitioner needs to file a certificate of service showing that a copy of the MANDAMUS PETITION was mailed or delivered to the DISTRICT-COURT JUDGE. The certificate of service should be e-filed separate from unrelated submissions. (RFH) [Entered: 05/22/2025 04:08 PM] |
