Date Filed Document Text
October 24, 2025 Opinion or Order Filing 33 ORDER (Clerk) No action will be taken on the foregoing submission. In No. 25-1748, the Court denied Jones's petition for writ of mandamus on June 27, 2025. That order concluded the proceedings in that case. In No. 25-1787, the Court summarily affirmed the district court's decision on August 22, 2025. Except for Jones's opportunity to seek rehearing, that decision concluded the appeal. It is noted that Jones's petition for rehearing is currently pending with the Court. The parties will be advised when a decision has been entered on the petition for rehearing.. [25-1748, 25-1787]. (PDB) [Entered: 10/24/2025 03:50 PM]

Certificate of Service dated 10/22/2025. Service made by ECF. [25-1787, 25-1748] (JJ) [Entered: 10/22/2025 09:20 PM]
September 23, 2025 Filing 31 ECF FILER: Motion filed by Appellant Jazzmin Jones in 25-1787 to Incorporate Exhibits and Appendix in Support of En Banc Petition to order dated 09/15/2025. Certificate of Service dated 09/23/2025. Service made by ECF. [25-1787, 25-1748]--[Edited 09/23/2025 by PDB] (JJ) [Entered: 09/23/2025 08:11 AM]
September 15, 2025 Opinion or Order Filing 30 ORDER (Clerk) Jazzmin Jones electronically filed the above-listed documents in both No. 25-1748 and No. 25-1787. The motion to recall the mandate will be submitted to the Court in No. 25-1748 for whatever consideration the Court deems appropriate. In that case, the Court denied Jones's petition for a writ of mandamus on June 27. The Court does not issue mandates after deciding petitions for writs of mandamus. No action will be taken on the motion to recall the mandate in No. 25-1787. The Court summarily affirmed the district court's decision on August 22, but the Court's mandate has not yet issued. No mandate will issue until Jones has a chance to seek rehearing. See Fed. R. App. P. 41(b). Jones's petition for rehearing challenges the decisions made by the Court in No. 25-1787. It will be considered in that case only. Because it is now clear Jones's earlier motion was not her petition for rehearing, the August 29 noncompliance order issued in No. 25-1787 is vacated. Under this Court's Local Appellate Rules 35.2(a) and 40.1(a), petitions for rehearing may include copies of the Court's decisions as to which rehearing is sought. Other exhibits are not authorized. Jones's petition for rehearing includes unauthorized exhibits. If she wants the Court to consider her petition for rehearing, she must file a motion asking the Court for permission to include those exhibits. That motion must be filed in No. 25-1787 within fourteen days of this order. No action will be taken on the petition for rehearing until this deficiency is corrected. [25-1748, 25-1787]. Certificate of Service dated 08/27/2025. Service made by ECF. [25-1787]--[Edited 08/29/2025 by PDB]--[Edited 08/29/2025 by PDB] (JJ) [Entered: 08/27/2025 02:24 PM]
August 22, 2025 Opinion or Order Filing 26 ORDER (KRAUSE, PHIPPS and SCIRICA, Circuit Judges) We have considered Appellant Jazzmin Jones's supplemental submission in response to our June 12, 2025 order. Contrary to Jones's argument, our appellate jurisdiction is limited to the District Court's refusal to grant injunctive relief, see 28 U.S.C. Section: 1292(a)(1), as her damages claims remain pending in the District Court. See Fed. R. Civ. P. 54(b). Furthermore, and for substantially the same reasons given by the District Court, we agree with the denial of Jones's requests for injunctive and declaratory relief, as she has not established circumstances that warrant such relief at this time. See Sprint Commc'ns, Inc. v. Jacobs, 571 U.S. 69, 79 (2013); Middlesex Cnty. Ethics Comm. v. Garden State Bar Ass'n, 457 U.S. 423, 435 (1982); Moore v. Sims, 442 U.S. 415, 419-20 (1979); Younger v. Harris, 401 U.S. 37, 53-54 (1971); Malhan v. Sec'y U.S. Dep't of State, 938 F.3d 453, 461 (3d Cir. 2019). Accordingly, we summarily affirm the orders of the District Court denying Jones's requests for injunctive and declaratory relief. See Murray v. Bledsoe, 650 F.3d 246, 247 (3d Cir. 2011) (per curiam); see also 3d Cir. L.A.R. 27.4; 3d Cir. I.O.P. 10.6. Jones's pending motions and remaining requests for relief on appeal are denied. This order concludes this appeal.. Panel ID: CLD-175 Judge: SCIRICA Authoring (JK) [Entered: 08/22/2025 03:12 PM]

June 12, 2025 Filing 22 ECF FILER: Show Cause Response filed by Party Jazzmin Jones in 25-1748, 25-1787. [25-1748, 25-1787] (JJ) [Entered: 06/12/2025 07:28 PM]
June 12, 2025 Opinion or Order Filing 21 ORDER (KRAUSE, PHIPPS and SCIRICA, Circuit Judges) Appellant Jazzmin Jones's requests for injunctive and declaratory relief are denied. Jones asks this Court to issue an order facilitating the return of her minor children to her custody while her state child custody proceedings are pending, and to issue prospective declaratory relief against individuals and entities involved with those proceedings. For substantially the reasons given by the District Court in denying her requests for injunctive and declaratory relief, we conclude that Jones has not established circumstances that warrant injunctive or declaratory relief at this time. See Sprint Commc'ns, Inc. v. Jacobs, 571 U.S. 69, 79 (2013); Middlesex Cnty. Ethics Comm. v. Garden State Bar Ass'n, 457 U.S. 423, 435 (1982); Moore v. Sims, 442 U.S. 415, 419-20 (1979); Younger v. Harris, 401 U.S. 37, 53-54 (1971); Malhan v. Sec'y U.S. Dep't of State, 938 F.3d 453, 461 (3d Cir. 2019). Jones's remaining pending motions are denied. Jones is advised that we will consider taking summary action in this appeal. See 3d Cir. L.A.R. 27.4; 3d Cir. IOP 10.6. Jones may file a response on that issue, not to exceed five pages, within 14 days of the date of this order. This response also should address whether and to what extent this Court has appellate jurisdiction given that some of her claims remain pending before the District Court. See 28 U.S.C. Section 1291 & 1292(a)(1); Fed. R. Civ. P. 54(b).. Panel No. CLD-160. Scirica, Authoring Judge. (PDB) [Entered: 06/12/2025 04:08 PM]
