ORDER (BIBAS, PORTER and MONTGOMERY-REEVES, Circuit Judges) Summary action is appropriate if there is no substantial question presented in the appeal. See 3d Cir. LAR 27.4. For essentially the reasons given by the District Court, we summarily affirm the District Courts order. See 3d Cir. I.O.P. 10.6; Maio v. Aetna, Inc., 221 F.3d 472, 483 (3d Cir. 2000) (explaining that plaintiff must show injury to business or property caused by racketeering activities to establish standing); Stump v. Sparkman, 435 U.S. 349, 35557 (1978) (stating that judges not civilly liable for judicial acts); McGillvary v. Netflix, Inc., No. 2:23-CV-01195-JLS-SK, 2024 WL 3588043, at *8 (C.D. Cal. July 30, 2024) (dismissing copyright infringement claims based on the fair-use doctrine). McGillvarys pending motions are denied. See Linda R.S. v. Richard D., 410 U.S. 614, 619 (1973) (holding that an individual has no federal right to require the government to initiate criminal proceedings). ORDER (Clerk) Insofar as the foregoing motion requests a ruling by Emil Bove, whose appointment to the U.S. Court of Appeals for the Third Circuit was recently confirmed, no action can be taken. Federal Rule of Appellate Procedure 27(c) does not authorize filing of a motion directed to a particular judge. As we previously advised you, the judges of this Court may act only in the context of a case which has been assigned to them for decision. Accordingly, your motion directed to Emil Bove will be submitted to the same panel of this Court that will consider your appeal and other filings in the case as captioned above. Filing 60
ORDER (Clerk) At the direction of the Court, the motions to recuse the case manager and to recuse several judges of this Court are denied. To the extent the motion is directed at judges who are already recused or retired, the motion is denied as unnecessary. With respect to the remaining judges named in the motion, the motion is denied because McGillvary has not shown that any of those judges has a personal bias or that their impartiality might reasonably be questioned. See generally 28 U.S.C. 455; Liteky v. United States, 510 U.S. 540, 555 (1994). McGillvarys unsubstantiated accusations of bias and complaints regarding the case manager do not warrant any relief. In light of our disposition, to the extent that McGillvary has requested additional time to brief these motions, the request is denied.. It is noted that a briefing schedule has not yet been issued in this matter. ORDER (Clerk) Action on Appellant's Motions "under 28 U.S.C. Section: 455(a)"t are deferred. The beginning of each motion asks to disqualify all judges "who hold their office in" New Jersey or who were "recommended for nomination" by former Senator Menendez. Later, the motions reference all judges "located in" New Jersey or "recommended for appointment" by former Senator Menendez. The appellant does not name the judges whom he wants to disqualify, and his potentially inconsistent descriptions do not make clear the relief sought. Motions to disqualify judges must state the relief sought with particularity, see Fed. R. App. P. 27(a)(2)(A); 3d Cir. L.A.R. 26.1.2(b), and they should identify the judges by name, cf. 3d Cir. L.A.R. 26.1.2(a). Within fourteen days of this order, the appellant must file a supplement to his motions naming the judges he wants to disqualify. If no such supplement is filed, the motions may not be considered further. [25-1335, 25-1823, 25-1788, 25-2000] (JK) [Entered: 06/18/2025 12:40 PM]
