ORDER (Clerk) deferring action on the motions by Appellant for leave to accept late filing of brief and for extension of time to file opening brief. On September 8, 2025, Appellant submitted an informal brief (ECF No. 11), along with a motion to accept the late filing of the brief and a motion for an extension of time to file an opening brief. The Federal Rules of Appellate Procedure do not contemplate the filing of multiple merits briefs. Accordingly, within fourteen (14) days of the date of this Order, Appellant must advise the Clerk, in writing, whether the informal brief submitted on September 8, 2025, is intended to serve as Appellant's merits brief, or whether Appellant intends to file a substitute brief. If Appellant elects to file a substitute brief, the brief must be filed within thirty (30) days of the date of this Order. Upon the filing of a substitute brief, the Clerk will remove the informal brief that was submitted on September 8, 2025 (ECF No. 11), from the Court's docket. Appellees' briefs must be filed either within thirty (30) days of Appellant's notice electing to stand on the previously filed informal brief, or within thirty (30) days of the date of service of any substitute brief that may be filed.
