August 6, 2025 Opinion or Order Filing 10 ORDER (Clerk) The foregoing submissions are considered. Appellant's notice to the Court regarding Appellees' correspondence is noted. However, Appellant is advised that, as a matter of customary practice, parties are generally expected to seek the consent of the opposing party prior to the formal filing of motions with the Court. Here, Appellees filed their motion for extension of time promptly after seeking Appellant's consent. To the extent Appellant's notice may be construed as a response in opposition to the motion for extension of time, the response is considered. Appellees' motion for extension of time to file brief and supplemental appendix until October 20, 2025, is granted. Appellees are, however, advised extensions of time are generally disfavored and that any further requests will be presented to the Court and must be based on exceptional circumstances. Furthermore, this Order does not automatically grant leave to file a supplemental appendix. Should Appellees file such an appendix, a separate motion requesting leave to do so must be filed before or at the time of filing the supplemental appendix. Any motion for leave to file a supplemental appendix must specify whether the documents contained in the supplemental appendix are part of the district court record, and, if so, must provide exact references to where each document appears in that record. To the extent Appellant requests to remand the case to the District Court in light of due process violations, the motion is referred to the merits panel. Any response to the request to remand must be filed within ten (10) days of the date of this Order.
