The appellant's request to represent himself is therefore denied. His appointed counsel, Coley O. Reynolds, Esq. is relieved from these appeals. The appellant will remain represented in these appeals by retained counsel, Ronald W. Chapman II, Esq. While represented by counsel, the appellant ordinarily may not file pro-se motions, briefs, or other documents. See 3d Cir. L.A.R. 27.8, 31.3. [25-2804, 25-2902] (TMM) [Entered: 11/18/2025 04:51 PM]

October 21, 2025 Opinion or Order Filing 25 ORDER (Clerk) The defendant has two appeals pending in this Court. No. 25-2804 was filed between the guilty verdict and sentencing. No 25-2902 was filed after sentencing. The appeals have been consolidated, and Coley O. Reynolds, Esq. was appointed to represent the defendant in both appeals. Absent "extraordinary circumstances," trial counsel is expected to continue on appeal. The defendant has moved to remove his court-appointed counsel and represent himself. If the motion is granted, Coley O. Reynolds, Esq., will be relieved and the defendant will be made pro se in both appeals. Action on Appellant's motion to proceed pro se is deferred pending Appellant's filing of a waiver of counsel form or written statement as directed. This Court in its discretion may permit an appellant to proceed pro se if an appellant knowingly and voluntarily waives the right to counsel. The Supreme Court has instructed that in order for a waiver to be knowing and voluntary, a litigant must be "made aware of the dangers and disadvantages of self representation". Accordingly, Appellant may elect to either waive counsel and proceed pro se on appeal or accept representation by Coley O. Reynolds, Esq. Appellant must make his election known to the Clerk by filing the waiver of counsel form or by filing a written statement accepting representation by Coley O. Reynolds, Esq. within 14 days of this order. In the event Appellant fails to respond to this Order, it will be presumend that Appellant has choses to remain represented by Coley O. Reynolds, Esq., and the motion will be denied. [25-2804, 25-2902] (SEE ATTACHED ORDER FOR FULL TEXT)--[Edited 10/21/2025 by TMM] (TMM) [Entered: 10/21/2025 09:27 AM]

The parties are advised that all case-opening forms, motions, and briefs must be electronically filed in all cases on the Court's electronic filing (ECF) system. The appeal docketed at No. 25-2804 will not be submitted to a motions panel for possible dismissal due to a jurisdictional defect at this time.
