October 21, 2025 Opinion or Order Filing 12 ORDER (Clerk) The defendant has two appeals pending in this Court. No. 25-2804 was filed between the guilty verdict and sentencing. No 25-2902 was filed after sentencing. The appeals have been consolidated, and Coley O. Reynolds, Esq. was appointed to represent the defendant in both appeals. Absent "extraordinary circumstances," trial counsel is expected to continue on appeal. The defendant has moved to remove his court-appointed counsel and represent himself. If the motion is granted, Coley O. Reynolds, Esq., will be relieved and the defendant will be made pro se in both appeals. Action on Appellant's motion to proceed pro se is deferred pending Appellant's filing of a waiver of counsel form or written statement as directed. This Court in its discretion may permit an appellant to proceed pro se if an appellant knowingly and voluntarily waives the right to counsel. The Supreme Court has instructed that in order for a waiver to be knowing and voluntary, a litigant must be "made aware of the dangers and disadvantages of self representation". Accordingly, Appellant may elect to either waive counsel and proceed pro se on appeal or accept representation by Coley O. Reynolds, Esq. Appellant must make his election known to the Clerk by filing the waiver of counsel form or by filing a written statement accepting representation by Coley O. Reynolds, Esq. within 14 days of this order. In the event Appellant fails to respond to this Order, it will be presumend that Appellant has choses to remain represented by Coley O.
