| Filing 8 CLERK ORDER Upon further review, it appears that it would be inappropriate at this time to submit this appeal to a motions panel of the Court to determine whether to dismiss the appeal for lack of appellate jurisdiction. This order does not, however, represent a finding of jurisdiction. The panel of this Court that reviews the case on its merits will make a final determination regarding jurisdiction. A briefing schedule shall issue. Among any other issues Appellant may wish to address in his brief, he is directed to address whether, if the District Court were to permit him to file a second amended complaint, he could plausibly plead a Takings Clause claim now that the subject real property has been sold. See Tyler v. Hennepin County, Minnesota, 598 U.S. 631, 63839 (2023). In addressing that issue, Appellant should tabulate and describe the true equity in the property at the time of sale, accounting for any liens and permissibly deductible expenses incurred by certain of the un-served defendants. See, e.g., DC ECF No. 11 at 56. Finally, Appellant is directed to promptly respond to this order with a statement of whether he intends to proceed with his motion to stay the appeal, following the denial of certiorari in McGee v.
