ORDER (RESTREPO, PORTER and MONTGOMERY-REEVES, Circuit Judges) We grant appellants requests: (1) to reopen the appeal, (2) to proceed in forma pauperis, and (3) for an extension of time to submit his affidavit of poverty in support of his application to proceed in forma pauperis. Upon further review, it appears that it would not be appropriate to submit this appeal to a panel of the Court at this time for possible dismissal for a jurisdictional defect. This order does not represent a finding of appellate jurisdiction in this case. As in all cases, the panel of this Court that reviews the case on its merits will make a final determination of appellate jurisdiction. However, the appeal will be submitted to a panel of this court for determination under 28 U.S.C. 1915(e)(2) as to whether the appeal will be dismissed as legally frivolous or whether summary action under Third Circuit L.A.R. 27.4 and I.O.P. 10.6 is appropriate. In making this determination, the district court opinion and record will be examined. Appellant may submit argument, which should not exceed 5 pages, in support of the appeal.
