Filing 3
NONCOMPLIANCE Order sent to Petitioner Michael J. Robinson. Action on the above-captioned petition for writ of mandamus and motion for leave to proceed in forma pauperis ("IFP") is hereby deferred. The IFP motion submitted with the mandamus petition was not sufficiently complete for the Court to rule on at this time. It did not include an affidavit of poverty in the form prescribed by the Federal Rules of Appellate Procedure. The petitioner must provide those documents to this Court if he wants to proceed in forma pauperis. See 3d Cir. L.A.R. 24.1(c). Within fourteen (14) days of the date of this order, Petitioner must either remit payment of the $600 docketing fee or complete his IFP motion by filing the required affidavit of poverty. A form affidavit is enclosed for Petitioner's convenience. The mandamus petition and motion to expedite will not be submitted to the Court until the docketing fee has been paid or leave to proceed in forma pauperis has been granted. See Fed. R. App. P. 21(a)(3). If neither the fee nor a compliant IFP motion is received by the deadline, the petition will be dismissed without further notice. See 3d Cir. L.A.R. 3.3(a), 24.2, 107.1(a).
