ORDER (BIBAS, PHIPPS and NYGAARD, Circuit Judges) We decline to dismiss the case for lack of appellate jurisdiction, but Cox's request for a certificate of appealability is denied. See 28 U.S.C. Section: 2253(c). Jurists of reason would agree, without debate, that the District Court properly denied Cox's habeas petition as meritless, for essentially the reasons set forth in the District Court's opinion. See Miller-El v. Cockrell, 537 U.S. 322, 336 (2003); Slack v. McDaniel, 529 U.S. 473, 484 (2000). Cox's motion for appointment of counsel is also denied. See 18 U.S.C. Section: 3006A(a)(2).
