ORDER (Clerk) The foregoing motion to proceed in forma pauperis is granted. Appellant was previously advised that the appeal will be submitted for possible dismissal due to a question regarding jurisdiction. The appeal will also be submitted to a panel of this court for determination under 28 U.S.C.
