Date Filed Document Text
June 1, 2026 Opinion or Order Filing 19 ORDER (SHWARTZ, FREEMAN and CHUNG, Circuit Judges) Given that Appellants have paid the filing fees for this appeal, their motion to proceed in forma pauperis is denied as moot. However, this appeal is dismissed for lack of appellate jurisdiction. Subject to exceptions that are not applicable here, [a]n order remanding a case to the State court from which it was removed is not reviewable on appeal or otherwise. 28 U.S.C. 1447(d). [R]emands based on grounds specified in 1447(c) are immune from review under 1447(d). Things Remembered, Inc. v. Petrarca, 516 U.S. 124, 127 (1995). Relevant here, 1447(c) provides that [i]f at any time before final judgment it appears that the district court lacks subject matter jurisdiction, the case shall be remanded. Because the District Courts remand order was based upon a lack of subject matter jurisdiction, see A.S. ex rel. Miller v. SmithKline Beecham Corp., 769 F.3d 204, 209 (3d Cir. 2014), this Court lacks jurisdiction to review it. See Cook v. Wikler, 320 F.3d 431, 434 n.3, 439 (3d Cir. 2003). Appellants motion to strike is denied. Panel No.: ALD-132. Freeman, Authoring Judge. (SB) [Entered: 06/01/2026 10:14 AM]

February 19, 2026 Opinion or Order Filing 17 ORDER (Clerk) No action will be taken on the notice and withdrawal. A review of the District Court docket does not show that the $605 fee was paid there. January 5, 2026 Opinion or Order Filing 10 ORDER (Clerk) The motion to proceed in forma pauperis is referred to a motions panel. If the Court determines that the appellant may proceed in forma pauperis, the Court will proceed to determine whether the appeal will be dismissed as legally frivolous under 28 U.S.C. Section 1915(e)(2) or whether summary affirmance under Third Circuit L.A.R.27.4 and I.O.P. 10.6 is appropriate. In making this determination, the district court opinion and record will be examined. Appellant may submit argument, not to exceed 5 pages, in support of the appeal. The document, with certificate of service, must be filed with the Clerk within 21 days of the date of this order.
