February 4, 2026 Opinion or Order Filing 16 ORDER (Clerk) On January 21, 2026, the Court received a motion from the appellant requesting to voluntarily withdraw the above-captioned appeal. The Clerk mistakenly took no action on that motion in an order entered January 28, 2026. Accordingly, the Clerk's January 28, 2026, order is hereby VACATED. Thereafter, on February 3, 2026, the Court received a motion from the appellant requesting that his court-appointed counsel be relieved and that he be permitted leave to proceed pro se in this appeal. Action on the foregoing motions is deferred pending a further response from the appellant. If the appellant still wishes to withdraw his appeal, he must notify the Court in writing within 14 days of the date of this order. If the appellant wishes to proceed with his appeal in pro-se capacity, he must file a signed waiver of counsel form within the same 14-day period. In the event the appellant fails to respond to this order by the deadline, it will be presumed that the appellant has chosen to continue to be represented by the Federal Public Defender in this appeal, and his motions to voluntarily withdraw the appeal and to relieve counsel will be denied.
