ORDER (Clerk) Appellant filed a pro-se notice of appeal seeking review of the district courts pretrial detention order entered July 21, 2025. It is noted that the district court permitted Appellants counsel leave to withdraw and directed Appellant to notify the court whether he would be hiring a private attorney or requesting the appointment of counsel under the Criminal Justice Act (CJA). Appellant is advised that there is no right to proceed pro se on appeal. See Martinez v. Court of Appeal of California, 528 U.S. 152 (2000). This Court in its discretion may permit an appellant to proceed pro se if an appellant knowingly and voluntarily waives the right to counsel. Within fourteen (14) days of the date of this order, Appellant must advise the Clerk whether he intends to proceed pro se, retain new counsel, or request the appointment of counsel under the CJA. If Appellant intends to waive counsel and proceed pro se, he must sign and file a waiver of counsel form. Appellee may file and serve a response to the pro-se motion for release within three (3) days of the filing of the waiver form. If Appellant elects to retain new counsel or have counsel appointed under the CJA, new counsel must file and serve a motion for release within seven (7) days of counsels entry of appearance. Appellee may file and serve a response to the motion for release within three (3) days after service of the motion. (LMR) [Entered: 01/28/2026 04:31 PM]
