ORDER (Clerk) The parties are advised that, pursuant to Chapter 10.6 of the Internal Operating Procedures of the United States Court of Appeals for the Third Circuit, the above-captioned appeal will be considered for possible summary action by a panel of this Court. See also Third Circuit Local Appellate Rule 27.4. Chapter 10.6 provides that the Court sua sponte (by its own action) may take summary action on an appeal if it appears that no substantial question is presented or that subsequent precedent or a change in circumstances warrants such action. Specifically, the Court may affirm, reverse, vacate, modify, or remand the judgment or order appealed. It is noted that appellees County of Chester, CO John/Jane Does Chester County Prison, Ronald M. Phillips, William Mann, and Maureen Treston have filed a motion requesting summary action, to which the appellant has not responded. While the other appellees have not filed their own motions for summary action, the Court will consider the possibility of summary action as to all appellees. The parties may, but are not required to, file responses regarding possible summary action within twenty-one (21) days of the date of this order.
