July 16, 2026 Filing 14 AMENDED ORDER (RESTREPO, PORTER and MONTGOMERY-REEVES, Circuit Judges) Petitioner's pro se motion to stay removal to Mexico is granted. See Nken v. Holder, 556 U.S. 418, 434, 436 (2009). The Government's motion to dismiss the petition for review is referred to a regular sitting merits panel. See 3d Cir. I.O.P. 10.3.5 (2018); 3d Cir. I.O.P. 10.6 (2018). Further consideration of the petition for review is stayed pending a decision by the Court in the consolidated matters of R.C.B. v. Attorney General, C.A. No. 25-2358, Velasquez Banegas v. Attorney General, C.A. No. 25-2415, and Alvarez Gomez v. Attorney General, C.A. No. 25-2424; as well as stayed pending resolution of all claims that afford class-wide relief in D.V.D. v. U.S. Dep't of Homeland Sec., Civil Action No. 25-10676-BEM (D. Mass.). The Government is directed to file status reports every twenty-one (21) days apprising the Court whether the foregoing stays of the petition for review should be lifted. So long as Petitioner is proceeding pro se, he may, but is not required to, file a response within ten days of any status report filed by the Government. Finally, insofar as the Government requests vacatur of the June 4, 2026 order directing it to file the administrative record, the request is dismissed as moot. Panel No.: DLD-158.
