No action will be taken at this time on the Motion to Dismiss Appeal received from Appellant Mr. James Hulsey in light of questions asked in his cover letter regarding the filing fee. On 4/22/21, notice was issued advising of the court's receipt of the district court's denial of IFP certifying the appeal was not taken in good faith. If he chooses to challenge to the order, notice will be sent to the prison to have a hold placed on his account to insure collection of the filing fee. If he does not challenge the order, there would be no hold placed on his account. If he still wants to dismiss, a follow up response should be sent clarifying his intentions.
