Specifically, we will argue that the court erred in rejecting Plaintiffs' argument that the HB 1's ban on direct or indirect spending by noncitizens to support or oppose ballot measures violates the First Amendment because the government has no legitimate (much less compelling) interest in restricting speech related to ballot measures-which is pure issue related speech-or, in the alternative, because it is not narrowly tailored to advance that interest. We will also argue that the court could have enjoined HB 1 under several different theories, including that it is a content-based restriction on First Amendment-protected speech, that it is void for vagueness, that it is unconstitutionally overbroad, and that it violates equal protection. .
