No ; Please identify the party(ies) the appeal is being taken against: Mr. Jorge Rodrigues ; Issues: Plaintiff appeals the U.S. District Court's July 11, 2025 Order dismissing Plaintiff's case. Plaintiff submits that probable cause did not exist to justify Plaintiff's arrest, a violation of Plaintiff's Fourth Amendment rights. Nor did probable cause exist for Plaintiff's continued prosecution. Plaintiff set forth adequate evidence to demonstrate genuine issues of material fact relative to the unlawfulness of his arrest, the failure of the Defendants to dismiss his prosecution, Plaintiff's civil conspiracy claim, and Plaintiff's abuse of process claim. As such, the claims against Defendants Kelly and Phillips should not have been dismissed. Plaintiff's claims against the City of Campbell and/or Mayor Phillips should not have been dismissed because genuine issues of material fact exist relative to the Mayor and/or City's liability pursuant to Monell v.
