Appellant commenced the action below upon discovering that Appellee had used one of his copyright protected photographs without license or permission. Appellee filed a motion to dismiss the Complaint and upon a cross-motion, Appellant was granted permission to file an amended Complaint to add a second infringement to the claim. Appellee then filed a motion for judgment on the pleadings on its defense of fair use. That motion was granted and is the basis for this appeal On this appeal, Appellant will argue that the decision was erroneous because it did not adhere to recent Supreme Court precedent which held that courts must place greater emphasis on whether a secondary use was for commercial purposes and must examine all factors through that prism, which the Court did not. We will also argue that the Court erred in its consideration of the 4th fair use factor and did not view the evidence in a light most favorable to Appellant. See also attached statement .
