ORDER filed: We order Jenkins to explain in writing why the appeal should not be dismissed. The responsive brief must be submitted within 28 days of receiving this order in the mail. The responsive brief must be 15 pages or less. Upon receiving the responsive brief, the clerk will REMAND - in other words return the case - to the district court to review the motion to reopen the appeal in the first instance. The clerk will hold this case in abeyance - in other words, pause the progression of the case - until further order of the court. If the district court denies the motion, Jenkins may appeal the order denying that motion in the ordinary course, and the appeal of the denial of the motion to reopen the period for appealing will be consolidated with this case and submitted before the same panel.
