ORDER filed: The district court has remanded Tucker's action to the state court, and that decision is not reviewable on appeal. See 28 U.S.C. 1447(d). Given the remand, we could not offer Tucker any relief by reviewing the district court's denial of his motion to appoint counsel, even if that interlocutory order were otherwise appealable.
