October 9, 2013 Opinion or Order Filing 702091084 Filed opinion of the court by Judge Sykes. We respectfully ask the Minnesota Supreme Court, in an exercise of its discretion, to answer the following certified questions: 1) Is reliance an element of a breach-of-express-warranty claim? If so, what type of reliance is required: contract-like reliance or tort-like reliance? 2) If tort-like reliance is required for a breach-of-express-warranty claim, is one contracting party entitled to rely on the other s express, contractual representation of law? If such reliance is not justified and the party s warranty claim therefore fails, is a breach-of-contract action based on that same express contractual warranty also barred? We invite reformulation of the questions presented, and nothing in this certification should be read to limit the scope of the inquiry. Further proceedings in this court are stayed while this matter is under consideration by the Supreme Court of Minnesota. Daniel A. Manion, Circuit Judge; Diane S. Sykes, Circuit Judge and Sara Darrow, District Court Judge. [6522227-1] [6522227] [12-2210]--[Text updated 10/10/2013 by JR.]
