The denial of Wharrie's motion to dismiss the federal and state claims against him relating to the fabrication of false statements from a witness during the investigation in 1985 is AFFIRMED, but the denial of Kelley s motion to dismiss the 1998 state law claims against him is REVERSED with instructions that the district court reconsider that denial in light of the analysis in the opinion.
