Filed opinion of the court by Judge Ripple. The judgment of the district court is AFFIRMED with respect to the applicability of 735 ILCS 5/2-622 in federal district courts. The district court s decision to dismiss the plaintiffs wrongful death claim with prejudice is REVERSED. The district court s grant of summary judgment to Sheriff Walsh and to HPL is AFFIRMED. The case is REMANDED to the district court for further proceedings consistent with this opinion. Each party will bear its own costs in this appeal. Kenneth F.
