Filing 702665858 ORDER: re: 1. The Tribal Entities' motion to correct clerical error in November 24, 2015 opinion. 2. Response of Godfrey & Kahn, S.C. to the Tribal Entities' motion to correct a clerical error in the November 24, 2015 opinion. [6713173-2] The motion is GRANTED. This court's opinion of November 24, 2015, is AMENDED as follows: In the first full sentence on page 39 of the opinion which currently reads, "Consequently, the Tribal Agreement does not 't[ie] the hands of the Tribe' in the same manner as the Indenture did" the term "Tribal Agreement" shall be replaced with "Tribal Resolution." Filing 702654687 Filed opinion of the court by Judge Ripple. We therefore AFFIRM the judgment of the district court with respect to the grant of preliminary injunctive relief to the Financial Entities. We REVERSE, however, the district court s denial of preliminary injunctive relief to Godfrey. The district court erred in concluding that it lacked subject matter jurisdiction over Godfrey, and that error colored its view of Godfrey s likelihood of success on the merits. Godfrey, like the Financial Entities, may invoke the forum selection clauses in the Bond Documents and, consequently, is likely to succeed on its claim that the tribal court lacks jurisdiction over it in this bond-related action. We therefore REMAND to the district court for further proceedings to determine whether, given the other preliminary-injunction factors, an injunction should issue in favor of Godfrey. Joel M. Flaum, Circuit Judge; Kenneth F. Ripple, Circuit Judge and Ann Claire Williams, Circuit Judge. [6710424-1] [6710424] [14-2150, 14-2287] |
